Schumer<br \/>\n<\/span><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">Majority Leader<br \/>\n<\/span><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">United States Senate<br \/>\n<\/span><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">Washington, D.C. 20510<br \/>\n<\/span><\/p>\n<p><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\">Dear Leader Schumer,<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\"><span style=\"font-weight: 400;\">We are workers and civil society organizations, and together, we urge you to protect workers and center their rights as Congress considers the promise and perils of artificial intelligence. Last month, members of Congress led by Senator Markey and Representative Jayapal <\/span><a href=\"https:\/\/www.markey.senate.gov\/news\/press-releases\/sen-markey-rep-jayapal-lead-colleagues-in-demanding-answers-from-ai-companies-on-use-of-underpaid-overworked-data-workers\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">sent a letter<\/span><\/a><span style=\"font-weight: 400;\"> to leading AI corporations demanding answers about the labor conditions of data workers, and the processes by which data workers contribute to training and deploying AI. The contributions of data workers, often invisible to the public, are critical to advancements in AI. The corporations failed to adequately answer the questions posed by members of Congress. We therefore urge you to consider how workers, across sectors, are already impacted by new technologies and respond to their demands.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\"><span style=\"font-weight: 400;\">Increasingly, employers are using artificial intelligence and related technologies in ways that undermine working conditions. Corporations like Amazon use constant, invasive workplace surveillance in order to maintain control over workers. In fact, Amazon is <\/span><a href=\"https:\/\/athenaforall.medium.com\/end-worker-surveillance-d99aa7cd3850\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">using surveillance<\/span><\/a><span style=\"font-weight: 400;\"> to retaliate against workers and undermine their protected rights to speak out and take collective action. Similarly, <\/span><a href=\"https:\/\/www.workingnowandthen.com\/blog\/surveillance-and-suppression-of-union-activity\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">employees at Google and Walmart<\/span><\/a><span style=\"font-weight: 400;\"> allege their employers embedded browser extensions and listening devices to quash organizing activities.\u00a0<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\"><span style=\"font-weight: 400;\">In addition to union busting, these massive corporations use electronic surveillance and automated management of workers and <\/span><a href=\"https:\/\/athenaforall.medium.com\/end-worker-surveillance-d99aa7cd3850\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">enforce<\/span><\/a><span style=\"font-weight: 400;\"> a dangerous pace of work, which has spurred a <\/span><a href=\"https:\/\/www.wired.com\/story\/a-damning-us-report-lays-bare-amazons-worker-injury-crisis\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">worker injury crisis<\/span><\/a><span style=\"font-weight: 400;\">. Amazon uses its package scanners not only to track packages, but also to measure the <\/span><a href=\"https:\/\/www.openmarketsinstitute.org\/publications\/eyes-everywhere-amazons-surveillance-infrastructure-and-revitalizing-worker-power\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">number of seconds<\/span><\/a><span style=\"font-weight: 400;\"> between each scan made by a worker, ensuring they maintain quotas as high as scanning and moving one item <\/span><a href=\"https:\/\/www.theatlantic.com\/technology\/archive\/2019\/11\/amazon-warehouse-reports-show-worker-injuries\/602530\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">every 11 seconds<\/span><\/a><span style=\"font-weight: 400;\"> over long shifts. Workers must <\/span><a href=\"https:\/\/revealnews.org\/article\/amazons-warehouse-quotas-have-been-injuring-workers-for-years-now-officials-are-taking-action\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">ignore safety precautions<\/span><\/a><span style=\"font-weight: 400;\"> in order to keep up. This breakneck pace of the work can cause <\/span><a href=\"https:\/\/www.theatlantic.com\/technology\/archive\/2019\/11\/amazon-warehouse-reports-show-worker-injuries\/602530\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">repetitive stress injuries<\/span><\/a><span style=\"font-weight: 400;\">. Similarly, FedEx workers must wear a heavy scanner <\/span><a href=\"https:\/\/www.thenation.com\/article\/archive\/these-workers-have-new-demand-stop-watching-us\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">strapped to the forearm<\/span><\/a><span style=\"font-weight: 400;\">, a surveillance tool that directly causes repetitive stress injuries as they move heavy boxes.\u00a0<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\"><span style=\"font-weight: 400;\">Due to employers\u2019 lack of <\/span><a href=\"https:\/\/datasociety.net\/library\/the-constant-boss\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">transparency<\/span><\/a><span style=\"font-weight: 400;\"> regarding the use of these tools, it is difficult to collect reliable statistics on the prevalence of surveillance systems. But recent surveys suggest close to <\/span><a href=\"https:\/\/www.cnbc.com\/2023\/04\/24\/employee-surveillance-is-on-the-rise-that-could-backfire-on-employers.html\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">80 percent<\/span><\/a><span style=\"font-weight: 400;\"> of employers use monitoring software to track employee performance and activity and nearly <\/span><a href=\"https:\/\/www.cnbc.com\/2023\/09\/08\/employers-using-ai-to-monitor-workers-has-negative-impact-on-employees.html#:~:text=Companies%20use%20AI%20to%20monitor,effect%20on%20their%20mental%20health&amp;text=As%20companies%20implement%20return%2Dto,workers%2C%20but%20to%20watch%20them.\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">half<\/span><\/a><span style=\"font-weight: 400;\"> of employees who are being monitored say these practices have a negative effect on their mental health. They describe being <\/span><a href=\"https:\/\/hbr.org\/2018\/04\/why-monitoring-your-employees-behavior-can-backfire\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">under coercive surveillance<\/span><\/a><span style=\"font-weight: 400;\"> with an eye toward <\/span><a href=\"http:\/\/bit.ly\/3UDkYVu\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">finding people to fire<\/span><\/a><span style=\"font-weight: 400;\">. A <\/span><a href=\"https:\/\/www.thenation.com\/article\/archive\/these-workers-have-new-demand-stop-watching-us\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">UPS driver said<\/span><\/a><span style=\"font-weight: 400;\">, \u201cIt\u2019s like you\u2019re fighting for your job every day.\u201d Amazon\u2019s surveillance-based relationship with its employees has been described as one of \u201ccontrol, <\/span><a href=\"https:\/\/www.openmarketsinstitute.org\/publications\/eyes-everywhere-amazons-surveillance-infrastructure-and-revitalizing-worker-power\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">humiliation and unabating anxiety<\/span><\/a><span style=\"font-weight: 400;\">.\u201d This \u201c<\/span><a href=\"https:\/\/www.thenation.com\/article\/archive\/these-workers-have-new-demand-stop-watching-us\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">management by stress<\/span><\/a><span style=\"font-weight: 400;\">\u201d can create a constant low-grade panic that seeps into a worker\u2019s private time and even invades their sleep. Decades of research shows that job strain, which occurs when workers face high job demands but have little control over their work, can lead to a wide variety of harmful health consequences, including <\/span><a href=\"https:\/\/www.cambridge.org\/core\/journals\/psychological-medicine\/article\/abs\/job-strain-and-psychiatric-morbidity\/A5D184C84871668990578F6311F5657D\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">anxiety<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/28122650\/#:~:text=Background%3A%20Adverse%20psychosocial%20working%20environments,clinically%20diagnosed%20depression%20is%20scarce.\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">depression<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/www.annualreviews.org\/doi\/abs\/10.1146\/annurev.pu.15.050194.002121?journalCode=publhealth\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">cardiovascular disease<\/span><\/a><span style=\"font-weight: 400;\">, and <\/span><a href=\"https:\/\/academic.oup.com\/pmj\/article-abstract\/90\/1065\/402\/6992146\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">hypertension<\/span><\/a><span style=\"font-weight: 400;\">. Elevated stress further compromises the ability of workers to prevent injuries.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\"><span style=\"font-weight: 400;\">In some industries, employers use <\/span><a href=\"https:\/\/datasociety.net\/library\/explainer-algorithmic-management-in-the-workplace\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">automated management<\/span><\/a><span style=\"font-weight: 400;\"> systems to hire and fire workers. Such tools often serve to further marginalized groups of workers that have historically faced higher levels of surveillance and scrutiny. These systems have penalized workers for <\/span><a href=\"https:\/\/interaktiv.br.de\/ki-bewerbung\/en\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">wearing a headscarf<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/www.wbur.org\/hereandnow\/2021\/08\/18\/name-discrimination-jobs\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">having a Black-sounding name<\/span><\/a><span style=\"font-weight: 400;\">, and <\/span><a href=\"https:\/\/www.reuters.com\/article\/us-amazon-com-jobs-automation-insight\/amazon-scraps-secret-ai-recruiting-tool-that-showed-bias-against-women-idUSKCN1MK08G\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">mentioning a women\u2019s college<\/span><\/a><span style=\"font-weight: 400;\">. Some workers have been <\/span><a href=\"https:\/\/bloomberg.com\/news\/features\/2021-06-28\/fired-by-bot-amazon-turns-to-machine-managers-and-workers-are-losing-out\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">fired by automated systems<\/span><\/a><span style=\"font-weight: 400;\">, sometimes without cause or method of recourse. In the gig economy, workers are subject to algorithmic wage discrimination, <\/span><a href=\"https:\/\/papers.ssrn.com\/sol3\/papers.cfm?abstract_id=4331080\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">described<\/span><\/a><span style=\"font-weight: 400;\"> by law professor Veena Dubal as \u201cthe use of granular data to produce unpredictable, variable, and personalized hourly pay.\u201d These consequential automated processes are so opaque that delivery workers in New York City call gig companies their \u201c<\/span><a href=\"https:\/\/peoplesworld.org\/article\/los-deliveristas-unidos-organizarse-contra-un-jefe-fantasma\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">jefe fantasma<\/span><\/a><span style=\"font-weight: 400;\">,\u201d or ghost boss.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\"><span style=\"font-weight: 400;\">In the AI industry itself, data workers are subject to low wages, wage theft, intense surveillance, <\/span><a href=\"https:\/\/www.fastcompany.com\/90906492\/google-bard-ai-raters-fired\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">retaliation against organizing<\/span><\/a><span style=\"font-weight: 400;\">, and <\/span><a href=\"https:\/\/drive.google.com\/file\/d\/1Krjs0obqHo5KgEG2ySLMKepiBy-s_NtP\/view;\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">arbitrary punishment<\/span><\/a><span style=\"font-weight: 400;\"> with no method for recourse. Some MTurk workers report making below federal minimum wage, while they receive no health insurance or benefits. As much as <\/span><a href=\"https:\/\/arxiv.org\/pdf\/2110.00169.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">a third<\/span><\/a><span style=\"font-weight: 400;\"> of workers\u2019 time is spent on uncompensated work and many are <\/span><a href=\"https:\/\/drive.google.com\/file\/d\/1Krjs0obqHo5KgEG2ySLMKepiBy-s_NtP\/view;\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">unpaid without explanation<\/span><\/a><span style=\"font-weight: 400;\">, while they are aggressively surveilled <\/span><a href=\"https:\/\/www.buzzfeednews.com\/article\/carolineodonovan\/upwork-freelancers-work-diary-keystrokes-screenshot\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">down to the keystroke<\/span><\/a><span style=\"font-weight: 400;\">. Amazon Mechanical Turk workers have <\/span><a href=\"https:\/\/www.coworker.org\/petitions\/end-the-harm-of-mass-rejections\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">banded together<\/span><\/a><span style=\"font-weight: 400;\"> to improve conditions, but Amazon and the employers on the platform have yet to comply.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\"><span style=\"font-weight: 400;\">Further, corporations use this technology in ways that puts workers at risk of being replaced, fissured (or \u201cgigified\u201d), deskilled, or <\/span><a href=\"https:\/\/rooseveltinstitute.org\/wp-content\/uploads\/2020\/07\/RI_Beyond-Automation_Working-Paper.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">paid less<\/span><\/a><span style=\"font-weight: 400;\">. Digital labor platforms like Uber and Amazon\u2019s Flex use automated management to actualize invisible corporate control of workers, <\/span><a href=\"https:\/\/ssir.org\/articles\/entry\/unrigging_the_gig_economy\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">despite asserting that the workers are independent businesses<\/span><\/a><span style=\"font-weight: 400;\">. As a result, platform workers are stripped of a host of labor rights and protections, and prone to <\/span><a href=\"https:\/\/www.dir.ca.gov\/dlse\/Lawsuits-Uber-Lyft.html\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">wage theft<\/span><\/a><span style=\"font-weight: 400;\">, <\/span><a href=\"https:\/\/www.wired.com\/story\/uber-and-lyft-are-more-likely-to-fire-drivers-of-color\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">discrimination<\/span><\/a><span style=\"font-weight: 400;\">, and <\/span><a href=\"https:\/\/www.npr.org\/2022\/04\/12\/1091068852\/gig-worker-deaths-report\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">on-the-job injury<\/span><\/a><span style=\"font-weight: 400;\">. Other employers have used AI to <\/span><a href=\"https:\/\/www.cbsnews.com\/news\/eating-disorder-helpline-chatbot-disabled\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">replace helpline workers<\/span><\/a><span style=\"font-weight: 400;\">, ultimately giving callers suffering from disordered eating harmful advice.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\"><span style=\"font-weight: 400;\">In some cases, workers have been able to fight back and steer technology outcomes in a better direction, and these victories offer a roadmap for expanding worker rights over technology. The Writers Guild of America, in its contract negotiations with the Alliance of Motion Picture and Television Producers, <\/span><a href=\"https:\/\/www.nbcnews.com\/pop-culture\/pop-culture-news\/writers-strike-negotiations-hung-language-ai-sources-say-rcna117041\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">bargained<\/span><\/a><span style=\"font-weight: 400;\"> specifically to ensure AI would not replace steps in their writing work. Ultimately, the union won a <\/span><a href=\"https:\/\/www.wsj.com\/business\/media\/hollywood-studios-can-train-ai-models-on-writers-work-under-tentative-deal-aedae589\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">deal<\/span><\/a><span style=\"font-weight: 400;\"> including worker rights to credit and compensation, regardless of whether AI is used in part of their work. These protections are crucial, and should be codified into law.\u00a0<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\"><span style=\"font-weight: 400;\">Finally, the normalization of workplace surveillance creates an environment where workers know they are constantly being watched and where employers can more easily engage in anti-union surveillance, making it more risky to speak out and organize for better conditions. The General Counsel for the National Labor Relations Board has <\/span><a href=\"https:\/\/www.nlrb.gov\/news-outreach\/news-story\/nlrb-general-counsel-issues-memo-on-unlawful-electronic-surveillance-and\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">warned<\/span><\/a><span style=\"font-weight: 400;\"> that such uses of surveillance may chill workers\u2019 legally protected organizing rights. This is particularly concerning for low-wage workers, gig workers, or otherwise typically marginalized including Black and Latinx workers, for whom organizing for better conditions is <\/span><a href=\"https:\/\/www.nelp.org\/news-releases\/black-workers-see-higher-rates-employer-retaliation-raising-covid-workplace-safety-concerns\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">more risky<\/span><\/a><span style=\"font-weight: 400;\">.<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: tahoma, arial, helvetica, sans-serif;\"><span style=\"font-weight: 400;\">When employers are able to use new technologies in these ways, it not only impacts those particular workers\u2013it undermines our entire economy. Management practices spread rapidly, and as corporations like Amazon grow to become the largest employers in the private sector, and wield extraordinary power from the <\/span><a href=\"https:\/\/ainowinstitute.org\/wp-content\/uploads\/2023\/04\/AI-Now-2023-Landscape-Report-FINAL.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">concentration of data processing capacity<\/span><\/a><span style=\"font-weight: 400;\">, AI applications that hurt workers may spur a race to the bottom, lowering standards for all employers.\u00a0<\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400; font-family: tahoma, arial, helvetica, sans-serif;\">To guard against this dystopian future, Congress should develop a new generation of economic policies and labor rights to prevent corporations like Amazon from leveraging tech-driven worker exploitation into profit and outcompeting rivals by taking the low road. Establishing robust protections related to workplace technology and rebalancing power between workers and employers could reorient the economy and tech innovation toward more equitable and sustainable outcomes.<\/span><\/p>\n<p><span style=\"font-weight: 400; font-family: tahoma, arial, helvetica, sans-serif;\">In order to do this in the face of rapidly developing technology, Congress must act to:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; font-family: tahoma, arial, helvetica, sans-serif;\">Prioritize the health, safety, and wages of data workers that develop and train AI.<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400; font-family: tahoma, arial, helvetica, sans-serif;\">Fortify workers\u2019 right to organize and bargain around these issues, without being subject to employer surveillance and union-busting.<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400; font-family: tahoma, arial, helvetica, sans-serif;\">Protect against predatory surveillance and automated management practices that can harm our physical and mental health, undermine wages, and increase precarity.<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400; font-family: tahoma, arial, helvetica, sans-serif;\">Address \u2018black box\u2019 processes that have already proven to discriminate: hiring, firing, wage determination.<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400; font-family: tahoma, arial, helvetica, sans-serif;\">Change public policies that currently incentivize job replacement, deskilling, and fissuring (or \u201cgigify\u201d).<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400; font-family: tahoma, arial, helvetica, sans-serif;\">Guard against low-road business models that concentrate wealth and power away from working people into the hands of corporations.<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400; font-family: tahoma, arial, helvetica, sans-serif;\">Adopt a framework that addresses the underlying lack of transparency, due process and fairness, and job security in our at-will employment system in the U.S.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;
